Man Charged with Intoxication Manslaughter After Fatal UTV Rollover in Brazoria County

RICHWOOD, Texas – A 38-year-old man has been arrested on an intoxication manslaughter charge after an early morning UTV rollover crash in Brazoria County left a 33-year-old woman dead.

According to the Richwood Police Department, officers responded at approximately 3:30 a.m. on Sunday, August 9th, to a single-vehicle rollover involving an off-road utility terrain vehicle (UTV) in the 31000 block of Bayou Bend Drive.

During the investigation, officers determined the UTV had been occupied by multiple people. A 33-year-old female passenger was ejected during the rollover and was pronounced dead at the scene at approximately 3:57 a.m.

Driver Arrested Following Investigation

Investigators identified 38-year-old Sean Patrick Berkley as the driver of the UTV.

According to police, evidence gathered during the investigation indicated the vehicle was traveling at a high rate of speed before it rolled over. Officers also developed information suggesting alcohol was a contributing factor in the crash.

Based on the evidence, officers established probable cause to arrest Berkley on a charge of Intoxication Manslaughter under Texas Penal Code §49.08.

Berkley was taken into custody by the Richwood Police Department at approximately 5:15 a.m.

Search Warrant Obtained for Blood Sample

As part of the ongoing investigation, officers obtained and executed a search warrant authorizing the collection of a blood specimen from Berkley.

The blood sample has been submitted for forensic analysis.

The investigation remains active, and police said additional information may be released as it becomes available.

The Richwood Police Department is being assisted in the investigation by the Lake Jackson Police Department and the Texas Department of Public Safety.
