Travis County Grand Jury Clears Officers in November 2023 Use of Force Case

Travis County District Attorney José Garza announced that the Travis County Special Grand Jury, after concluding its review of the November 11, 2023, use of force case involving Austin Police Department SWAT Officer Jared Carruth #7291, SWAT Officer Kevin Olejar # 7788, and SWAT Sergeant Kevin De La Rue # 5907, did not return an indictment for the officers.

On November 11, 2023, during a SWAT standoff, Ahmed Mohamed Nassar fired his gun at officers, resulting in the fatal shooting of Austin Police Department Senior Officer Jorge Pastore and injury to another officer. In response, SWAT Officers Carruth and Olejar, along with SWAT Sgt. De La Rue, discharged their firearms. Mr. Nassar sustained multiple gunshot wounds, succumbed to his injuries, and was pronounced deceased on the scene.

Travis County District Attorney José Garza commended Austin Police Department Senior Officer Pastore, SWAT Officers Carruth and Olejar, SWAT Sgt. De La Rue, and the injured officer for their acts of bravery and courage. He acknowledged their willingness to put their safety and lives at risk during the incident, expressing gratitude for their service.
