Owner of Illegal Group Care Home Arrested in Montgomery County

MONTGOMERY COUNTY, Texas—A woman has been arrested for operating an unlicensed and unsafe group care home after allegedly failing to comply with a Fire Marshal’s order to cease operations.
On August 14, Montgomery County Fire Marshal’s Office (MCFMO) deputies responded to a complaint about unsafe living conditions at a home in New Caney. They found 10 residents, some with mobility issues, living in the home with no staff or caregivers present.
Deputies informed the property owner, Priscilla Walker, that her home was in violation of state law, which limits unlicensed group care homes to a maximum of three residents, and did not comply with the Montgomery County Fire Code. Officials from Texas Adult Protective Services (APS) confirmed the violations and began working to relocate the residents. Walker was issued a Fire Marshal’s Order to comply with the law before resuming operations.
However, a follow-up inspection on August 25 found that Walker had resumed operations with seven residents and no staff on site. A report was filed with the Montgomery County District Attorney’s Office, and a warrant was issued for her arrest.
Walker faces a Class B Misdemeanor for Violation of a County Fire Marshal Order, which is punishable by up to 180 days in jail and/or a fine of up to $2,000.
