Honduran National Sentenced to 60 Years for Aggravated Sexual Assault of a Child in Montgomery County

MONTGOMERY COUNTY, TX – A jury in Montgomery County has sentenced Heriberto Hernandez, a 33-year-old Honduran national, to 60 years in prison after he was convicted of Aggravated Sexual Assault of a Child.

The trial began on Monday, August 4, with jurors hearing testimony over two days from six witnesses, including the 13-year-old victim. The victim’s testimony detailed three years of abuse she suffered at the hands of the defendant.

The investigation was initiated after the victim’s mother discovered a series of letters between her daughter and Hernandez and reported them to the Montgomery County Precinct 3 Constable’s Office.

On August 5, the jury returned a guilty verdict. During the punishment phase, Chief Prosecutor Laura Bond introduced evidence of Hernandez’s previous Aggravated Assault with a Deadly Weapon to highlight his violent history. Bond requested a 60-year sentence, telling the jury, “The only way to keep him from doing this again is to incarcerate him.” The jury agreed, delivering the maximum sentence requested.

Under Texas law, Hernandez will be eligible for parole after serving 30 years. The Montgomery County District Attorney’s Office thanked the Precinct 3 Constable’s Office for its work on the case, which was prosecuted by Chief Prosecutor Laura Bond.
