Grimes County Inmate Pleads Guilty to Assault and Escape, Sentenced to 10 Years
Albino Hernandez-Guerrero, 52, pleaded guilty on Wednesday, December 11, 2024, to Aggravated Assault with a Deadly Weapon and Escape in the 506th District Court.
The incident began on July 23, 2021, when the Grimes County Sheriff’s Office responded to an assault call. Investigations revealed that Guerrero attacked a man with a knife, causing a serious laceration that required hospitalization. The victim was in a relationship with a woman who had previously been involved with Guerrero.
Guerrero was arrested and charged with Aggravated Assault with a Deadly Weapon, a second-degree felony, and booked into the Grimes County Jail.
On September 13, 2023, while working as a trusty within the jail, Guerrero escaped by walking out of the sallyport. A multi-agency manhunt involving TDCJ dog teams ensued, and Guerrero was apprehended by law enforcement with the assistance of local citizens. He was subsequently charged with Escape, a third-degree felony.
Before Judge Gary Chaney, Guerrero pleaded guilty to both charges. He was sentenced to 10 years in prison for each offense, with the sentences to be served concurrently. Guerrero remains in the Grimes County Jail awaiting transfer to the Texas Department of Criminal Justice.
District Attorney Andria Bender stated, “Albino Guerrero violently attacked a victim and then successfully escaped the Grimes County Jail. This escape consumed significant man-hours and taxpayer resources that could have been utilized to serve victims of crime and enforce the law. Our office strongly believed that only a maximum sentence was appropriate for this offense.”
