Two Men Accused of Repeatedly Raping 12-Year-Old Grandniece in Houston

HOUSTON, Texas – ICE Homeland Security Investigations (HSI) Houston and the Harris County Sheriff’s Office (HCSO) have arrested two men accused of the repeated sexual assault of a 12-year-old girl who was in the custody of her granduncle as her sponsor.

The two men arrested are:

  • Felix Bustillo Diaz, 49, a criminal illegal alien from Honduras.
  • Jose Gerber-Rivera, 45, a Salvadoran national.

Bustillo and Gerber-Rivera are accused of repeatedly raping Bustillo’s 12-year-old grandniece. The child was illegally smuggled into the U.S. in 2014 and was left alone with Bustillo as her sponsor.

Abuse and Further Victimization

The investigation revealed a complex chain of abuse and victimization:

  • Suspect Status: In 2024, despite being an illegal alien with a criminal conviction, Bustillo was granted Temporary Protected Status (TPS) by the Biden administration, which has since been terminated.
  • Kidnapping and Torture: At one point, the victim managed to escape from Bustillo with the help of Brenda Garcia, 38, and Tania Garcia, 37. However, the two Houston-area residents falsely claimed they were rescuing the minor, only to allegedly zip-tie, beat, torture, malnourish, and force her to perform manual labor.
  • Subsequent Arrests: HSI Houston and the Montgomery County Sheriff’s Office arrested the two women on October 3 for felony injury to a child, unlawful restraint, and invasive visual recording.

Rivera was taken into custody with the assistance of the Montgomery County Constables Office on November 4. Bustillo, who was already detained by ICE for immigration violations at the Montgomery Processing Center, was transferred into HCSO custody on November 5.

HSI Houston Special Agent in Charge Chad Plantz stated, “The conduct uncovered in this investigation was both disturbing and inexcusable.” HCSO Sheriff Ed Gonzalez and Montgomery County Sheriff Wesley Doolittle both emphasized the gravity of the “deeply disturbing” and “evil criminal behavior” uncovered.
