Two 14-Year-Olds Charged With Capital Murder In Deadly Houston Robbery

HOUSTON, Texas – Houston police have arrested two juvenile suspects in connection with a fatal shooting during a robbery in the MacGregor area earlier this year.

The suspects, both 14 years old, have been referred to Harris County Juvenile Probation Authorities on charges of capital murder. Due to their age, their identities have not been released.

The case stems from a January 20, 2026, incident around 8:55 p.m. in the 2520 block of Calumet Street.

Officers responding to a robbery call found 41-year-old James Tolen suffering from a gunshot wound. Houston Fire Department paramedics pronounced him deceased at the scene.

According to investigators, two armed suspects approached the victim’s vehicle and attempted to rob him. Both Tolen and a passenger complied with demands and exited the vehicle.

Police said the suspects were unable to start the vehicle and approached Tolen again to obtain the key. A physical altercation followed, during which one of the suspects fired a gun, striking Tolen.

The suspects then fled the scene on foot.

Through further investigation, detectives identified the two juveniles as suspects. After consulting with the Harris County District Attorney’s Office, charges of capital murder were accepted.

As of March 19, both suspects are in custody.
