Jury Hands Down 35-Year Sentence for Continuous Sexual Abuse in Montgomery County

MONTGOMERY COUNTY, Texas—A Montgomery County jury has found Jason Rivera, 43, guilty of Continuous Sexual Abuse of a Child Under 14 and delivered a harsh sentence of 35 years in the Texas Department of Criminal Justice (TDCJ). Due to the nature of the crime, the sentence will be served day for day, without the possibility of parole.
The verdict was returned on October 23, 2025, following a weeklong trial in the 435th District Court before Judge Patty Maginnis.
Details of the Abuse and Conviction
Evidence presented at trial showed that the sexual abuse began in 2021 and continued until the child’s outcry in April 2024, targeting a victim between the ages of 10 and 13. Medical examinations confirmed injuries consistent with sexual abuse.
- Manipulation Tactics: Prosecutors revealed that Rivera used manipulation and intimidation, repeatedly telling the child that no one would believe her if she came forward.
- Destroyed Evidence: The defendant also destroyed the child’s journals, which documented the abuse.
In closing arguments, the prosecution countered the defendant’s attempts to discredit the victim, emphasizing: “He might have been able to destroy her diaries, but he couldn’t destroy the truth.”
During the punishment phase, jurors heard emotional testimony about the lasting impact the abuse has had on the primary victim and another child, including struggles with trust and self-worth.
Assistant District Attorney Criss Cole emphasized the significance of the outcome: “This verdict sends a clear message that in Montgomery County, justice will find you, and the truth will prevail.”
The case was prosecuted by Assistant District Attorneys Criss Cole and Clay Casey.
