Driver Arrested for DWI in School Pick-Up Line at Marshall Elementary

SPRING, Texas — On Friday, August 15, 2025, deputies with Constable Mark Herman’s Office responded to the 24400 block of Birnamwood Boulevard after school personnel reported a suspected intoxicated driver in the pick-up line at Marshall Elementary in Spring ISD.

The driver, identified as 32-year-old Luis Funes-Rodriguez, was found asleep in his vehicle with the ignition on, creating a traffic hazard during dismissal. Deputies observed multiple signs of intoxication, and two beer cans were located inside the vehicle.

After conducting Standardized Field Sobriety Tests, deputies determined Rodriguez was intoxicated. A family member arrived on scene to pick up the child, and Child Protective Services was contacted.

Funes-Rodriguez was arrested and booked into the Harris County Jail on a charge of Driving While Intoxicated. His bond was set at $100 out of County Court 5.
