Child Sexual Abuser Gets 50-Year Prison Sentence in Bryan; Victim had Recanted Under Mother’s Pressure

BRYAN, TX – Jose Tzoc Garcia, 44, has been sentenced to 50 years in prison for Continuous Sexual Abuse of a Child Younger than 14. Due to the nature of the offense, there is no parole, meaning Garcia will serve the entirety of his sentence.
A Brazos County Jury convicted Garcia on May 21, 2025. The 50-year sentence was handed down by 361st District Court Judge David Hilburn after a punishment hearing concluded on July 22, 2025.
The jury heard compelling testimony from the primary victim, who detailed years of repeated sexual abuse by Garcia. A second child also testified to being sexually abused by the defendant. Both child victims lived in the same household as Garcia during the period the abuse was ongoing.
The primary victim had previously reported the sexual abuse in 2021 when she was 11 years old but recanted under pressure from her mother and in the belief that Garcia would stop. However, the abuse did not cease. Nearly a year later, the victim again reported Garcia’s continued conduct to her teacher, who then contacted the police.
Officers with the Bryan Police Department responded immediately, rescuing all the children from Garcia’s residence. Garcia was found hiding under a bed while the victim’s mother falsely told police he was at work. The victim’s mother had also taken the victim’s phone in an effort to prevent her from contacting authorities.
A sexual assault nurse examiner treated the victim the same day. Evidence collected during the examination revealed Garcia’s DNA on the victim’s breast, consistent with the most recent act of sexual abuse.
The child victims have since been adopted. The victim’s mother was prosecuted in a separate proceeding for endangering her children and was sentenced to serve time in a State Jail.
The Bryan Police Department investigated this case, which was prosecuted by Assistant District Attorneys Kevin Capps and Adam Andreski.
